The two new breeds whose power and prestige menace the amateur spirit are the professionals and the bureaucrats. Both are by-products of American wealth and American progress. But they can stifle the amateur spirit on which the special quality and vision of
our American Leaders must depend.

A Shooting at Maryland’s Capital-Gazette Newspaper, 5 Dead. by The Elephant's Child

A suspect named Jarrod Ramos was identified as the shooter who killed five journalists on Thursday at Maryland’s The Capital-Gazette newspaper. As soon as news of the shooting appeared, journalists were blaming President Trump. Apparently calling the press “fake news” and suggesting that inaccurate news is harmful to the country means he is responsible for someone killing five journalists. This is why they get called “fake news.”

Ben Rhodes, Obama’s deputy national security advisor famously said that journalists were easy—they were 28 years old and didn’t know anything. As I mentioned a new Axios/SurveyMonkeyPoll asked ‘How often do you think news sources report news they know to be fake, false or purposely misleading? Democrats 53%, Independents 79%, GOP 92%.  That should be a huge wake-up call to the journalist profession. Won’t happen.

The suspect had a long standing issue with the newspaper, going back years, long before Donald Trump ran for office. How interesting that supposedly unbiased “journalists” would instantly assume that it was Trump’s fault. Or that it would be assumed that Trump was ripping little children from the arms of their mothers, or that Trump was banning travel from Muslim countries because of racist prejudice against Muslims, or that the Wall on the Southern border was a racist effort to keep brown people from Mexico out of the country. So why would anyone think that “fake news” is a problem?

The Supreme Court Upheld Trump’s Travel Ban by The Elephant's Child
The Supreme Court has ruled in favor of President Trump and his immigration policy across the board, holding that the permanent entry restrictions from countries involved with terrorism and terrorist-prone nations codified in Presidential Proclamation is fully consistent with Congress’s Immigration and Nationality Act, as well as the Establishment Clause of the U.S. Constitution.

Chief Justice John Roberts wrote for the majority that admission and exclusion of foreign nationals is a “fundamental sovereign attribute exercised by the Government’s political departments largely immune from judicial control,” quoting from an earlier case, and that the president has extraordinarily broad discretion under 8 U.S.C. § 1182(f) to exclude aliens when he believes doing so is in the nation’s interests.

President Trump’s policy is permitted by the Establishment Clause of the First Amendment to the Constitution, because Presidential Proclamation 9645 provides a religion-neutral explanation for the policy that is facially legitimate, rejecting plaintiffs’ arguments that the policy advanced an impermissible religious purpose.

Democrats have a problematic history with race and racism. The election of the First Black President was supposed to absolve them from past history. But to make sure of it, they have taken every opportunity to accuse Republicans of Racism. They have made Racism the defining issue of our times, university and college campuses have been aflame with the racist question. Speakers shouted down or attacked because students are told they are racist.

Thus they attempted to turn Trump’s Travel Ban into a “racist ban.” Every “mainstream media” source speaks of the travel ban as a “Muslim Ban”, though it is no such thing. It is interesting that Democrats are unconcerned about terrorism, which has a record of mass murder all over Europe, and speak only of a religion. If there were any way to sort out the terrorists from the merely religious it would simplify the problems. President Trump’s first duty is to try to protect the American people.

When you are more worried about rejecting people on the basis religious differences when the plain, clear object is to ban ISIS fighters who thrive on blowing themselves up in the midst of big crowds, running airplanes into tall buildings, and attacking with machetes, knives or trucks — you’ve got your priorities badly mixed up.

One is not allowed to be Black and Republican. When Kanye West said that he liked the way Candace Owens spoke, a shock wave swept through the Democrat Party. That is not allowed.

A Huge News Day. Civil War Coming? by The Elephant's Child

A strange, strange news day. Lots of big news and local news as well. Here in Seattle, police officers are quitting the Seattle Police force, and moving to one of the suburbs, or the Sheriffs’ Office. They are fed up with the way they are being treated by the Seattle City Council and the Police Department management. They feel disrespected, over regulated to no purpose, and their safety is not a proper concern. Firemen are also protesting that they are being forced into unsafe situations with large numbers of homeless who are heroin and meth addicts.

In Portland, protesters have been blocking the ICE offices, demanding that ICE be shut down. Camped out around the offices, for some time. Leftist propaganda about separating children from mothers and claims that border control is “racist” are assumed to be fact.

Democrats have more or less lost their minds not just over the retirement of Justice Kennedy, but over the probability that President Trump will nominate another new conservative justice. President Trump will nominate someone who will respect and adhere to the Constitution, but Lefties are sure that it means that the court will end abortion and same-sex marriage, because they assume that all conservatives are ignorant southern racists and bigots.

Back in New York, in a primary election, incumbent Rep. Joe Crowley (D-NY) who was being mentioned as a future candidate for Speaker of the House was defeated by a 28 year-old Bernie Sanders supporting political novice. Crowley was chair of the House Democratic Caucus, and had not faced a primary challenge in 14 years. Alexandria Ocasio-Cortez crushed Crowley 57.6% to 42.4%. Exactly what this portends is unclear. It would seem to indicate unhappiness with the existing Congress.

Ocasio-Cortez is a proclaimed Socialist, apparently unaware that the inevitable result of Socialism is Venezuela. Interesting platform: Medicare for all, medicine, vision dental & mental health care. Universal Jobs Guarantee, living wage for everyone. Fully Funded Public Schools & Universities, tax Wall Street to support tuition-free public universities and trade schools. Paid Family and Sick Leave. Housing as a Human Right, safe secure habitable & affordable homes. Justice System Reform : end the War on Drugs, demilitarize our police and abolish for-profit incarceration. Immigration Justice: protect DREAMers & TPS recipients, simplify the paths to citizenship and abolish ICE.  Infrastructural Overhaul: Invest in 100% renewable green industry. Clean Campaign Finance: end corrupting influence of corporate finance in public elections. An Economy of Peace: support our veterans and actively values all humanity. Try not to laugh. This young woman has reached the age of 28 without learning anything whatsoever. The scary thing is that people actually voted for her, which demonstrates the ignorance of the electorate as well. Not the slightest idea of how any of this would be paid for, or even that it would have to be paid for.

Estimates of the number of guns in private hands in America vary widely. Nobody knows. The Small Arms Survey says 270 million. NPR says 246 million. There were 23 million background checks in 2015 —  3 X as many as in 2000. Probably mostly Republicans.

The question was asked by a Canadian, who suggested that Prime Minister Trudeau was trying to be the most politically correct leader ever.

Canada is accepting back those Canadians who have gone to the Middle East to fight with ISIS. One might want to ask Mr. Trudeau about that one too. Having them just across the Northern Border is somewhat disturbing. I cannot fathom what would make anyone want to go “fight with ISIS.” Strange.

A Day of Mourning. by The Elephant's Child

This is Scarlett. We had to put her down last night. Her innards gave up the battle. She was 17, and came to us when she was 3, from the Humane Society with the name “Moet” (tuxedo and black tie, get it?) We didn’t, so I gave her the name Scarlett after Scarlett O’Hara. “Scarlett O’Hara was not beautiful, but men seldom realized it when caught by her charm…” Utterly charming, but a bit of a bitch underneath. She was an alpha cat, and ruled the roost, and poor Sabrina (the other cat, much larger, but completely cowed). Had to drive to the 24- hour emergency vet in the next town at rush hour. Trouble with pets is they are not as long-lived as we are. We will miss her.

Re: The California Case against Big Oil — Dismissed! by The Elephant's Child

California’s Judge Alsup has just issued his Opinion and Order shutting down this litigation against BP, Chevron et al. He said several times that it is established and “both parties agree” that Global Warming is real, serious, and anthropogenic and the seas are inevitably rising.

That is irrelevant he wrote, because the California government entities ‘Nuisance theory’ is legally way too much of a stretch and just plain nuts. And issued the order dismissing the claim. Excellent, I will not argue.

He apparently just accepted that which he regarded as the highest authority, and in the case of the rising seas which would inundate San Francisco — He noted that San Francisco hadn’t even started to build  a sea wall!

Here’s the ruling: California v. BP.

The issue is not over science. All parties agree that fossil fuels have led to global warming and ocean rise and will continue to do so, and that eventually the navigable waters of the United States will intrude upon Oakland and San Francisco. The issue is a legal one — whether these producers of fossil fuels should pay for anticipated harm that will eventually flow from a rise in sea level.

The sole claim for relief is for “public nuisance,” a claim governed by federal common law. The specific nuisance is global-warming induced sea level rise. Plaintiffs’ theory, to repeat, is that defendants’ sale of fossil fuels leads to their eventual combustion, which leads to more carbon dioxide in the atmosphere, which leads to more global warming and consequent ocean rise.

The scope of plaintiffs’ theory is breathtaking. It would reach the sale of fossil fuels anywhere in the world, including all past and otherwise lawful sales, where the seller knew that the combustion of fossil fuels contributed to the phenomenon of global warming. While these actions are brought against the first, second, fourth, sixth and ninth largest producers of fossil fuels, anyone who supplied fossil fuels with knowledge of the problem would be liable. At one point, counsel seemed to limit liability to those who had promoted allegedly phony science to deny climate change. But at oral argument, plaintiffs’ counsel clarified that any such promotion remained merely a “plus factor.” Their theory rests on the sweeping proposition that otherwise lawful and everyday sales of fossil fuels, combined with an awareness that greenhouse gas emissions lead to increased global temperatures, constitute a public nuisance.

CFACT has put up a new billboard on the busy I-10 highway in Louisiana which reads: “Russia funneled Green Groups millions of dollars to oppose fracking & cripple American energy” and asks, “How’s that for COLLUSION?

The Russian economy depends on their energy exports. They want to reduce competition to their exports to Europe and their goal is to keep prices high and the world, especially Europe, dependent on Russia energy. What better allies could Mr. Putin find than American Greens?

Russia’s actions are well documented in a detailed report released by the U.S. House of Representatives this year.

Will the Once Great State of California Ever Recover From Jerry Brown? by The Elephant's Child

Down in the great state of California, Governor Moonbeam and the Legislature are suing BP (formerly British Petroleum) because the people using nasty fossil fuels (all of us and the American economy) are causing catastrophic global warming which is going to destroy the planet, or kill us all, or something like that. Except that it isn’t.

Our very own governor, who seems to copy every nitwit idea of Governor Moonbeam’s, either is doing his own lawsuit or is joining on California’s, I’m not sure. Our Governor, called locally “Sleepy Jay Inslee” is also trying to push a carbon tax on everybody who drives a vehicle.

This case against BP should be understood as the holy grail of potential jackpots for the legal profession. BP alone had $240.21 billion in revenue last year. Greedy lawyers are envisioning mammoth windfalls, and if they succeed in breaking BP, they can go on with all the other oil companies, breaking them one by one. $$$$$$  We can all rely on wind and solar which are useless, but beloved by Lefties. We could all drive useless electric cars (you think there would be any energy left to plug into your very expensive car?) The Left loathes Big Oil, but as with most things they loathe, don’t really know why they are supposed to do so. Big Oil is simply the name used to describe the world’s six or seven largest publicly traded oil and gas companies BP, Chevron, ExxonMobil, Royal Dutch Shell, Total SAand EniSpA and Phillips 66.  Demonized by the Left for the rare spills, when oil-soaked birds serve the same purpose in Leftist propaganda as the current kids in cages, separated, crying, from their mothers. Bad analogy. The oil-soaked birds are real, unfortunately. The kids in cages belong to president Obama.

Our freeways are so crowded that at rush hour a doctor said it took her over two hours to get home, a usual 25 minute drive. People are leaving the state and the outflow of people and business from California is huge.  California’s freeways are, it is reported, potholed, too crowded, and in poor condition while Jerry Brown pursues his high-speed rail to nowhere, and Elon Musk experiments with vacuum tube tunnels.

The Court has asked what the social cost of the use of fossil fuels is. Here’s the answer given the court.
